Terms of Service

Acceptance of terms

By creating an account or using the Phixmo platform, you agree to these terms of service. If you do not agree, do not use the service. These terms constitute a legally binding agreement between you (and, if applicable, the company you represent) and Phixmo LLC.

Description of service

Phixmo is a cloud-based construction management platform designed for small residential general contractors. The platform includes project cost tracking, time tracking with geofencing, invoicing with optional QuickBooks Online sync, change orders with customer approval, a customer portal, estimates and e-signature, compliance document management, AI-powered features including the Phix assistant, and related capabilities. Feature availability varies by subscription plan as described on the pricing page.

Account responsibilities

When you create an account, you agree to:

• Provide accurate and complete information during registration.
• Keep your password secure and not share your login credentials with others.
• Maintain one account per person. Shared logins are not permitted.
• Notify us promptly if you suspect unauthorized access to your account.
• Be responsible for all activity that occurs under your account.

Acceptable use

You agree not to:

• Use Phixmo for any illegal activity or in violation of any applicable laws.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Scrape, crawl, or use automated tools to extract data from the platform.
• Share your login credentials or allow others to access your account.
• Attempt to access data belonging to other organizations.
• Upload malicious files or content that could harm the platform or other users.
• Use the platform to send spam or unsolicited communications.

Billing and payment

Phixmo offers subscription plans billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• You can cancel your subscription at any time from the Settings page.
• Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial months.
• If your payment fails, we will attempt to charge your payment method again. If payment cannot be collected after reasonable attempts, your account may be downgraded.
• Prices may change with 30 days advance notice via email.

Free tiers and trials

Phixmo's Free plan is free forever and requires no payment method to sign up. A 30-day free trial of a paid plan is available once per organization; a payment method is required to start the trial, and it converts to a paid subscription automatically at the end of the trial unless cancelled first. Cancelling a trial drops the account to the Free plan with all data intact. We reserve the right to modify or discontinue free offerings with 30 days notice.

AI features disclaimer

Phixmo includes AI-powered features such as project estimation, budget anomaly alerts, receipt parsing, and weekly project summaries. These features are powered by Anthropic's Claude models.

AI-generated outputs are informational only and should not be treated as professional advice. Estimates are projections based on typical regional costs and are not guarantees. Budget alerts are based on the data you have entered and may not reflect all project costs. You are responsible for reviewing and verifying the accuracy of all AI-generated content before relying on it for bidding, budgeting, or any business decisions.

Data ownership

You retain full ownership of all data you enter into Phixmo, including project information, financial data, uploaded files, and any other content. By using the platform, you grant Phixmo a limited license to host, process, and display your data solely for the purpose of providing the service to you.

This license ends when you delete your account. We do not claim any intellectual property rights over your data.

Service availability

We strive to keep Phixmo available and reliable, but we do not guarantee 100% uptime. The platform is provided on a "best effort" basis. We may occasionally perform maintenance that temporarily limits availability, and we will provide advance notice when possible.

Enterprise plan customers may negotiate a separate Service Level Agreement (SLA) with defined uptime commitments and support response times.

Disclaimer of warranties

The platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that outputs (including AI-generated estimates and reports) will be accurate or complete. You are responsible for verifying anything you rely on for business decisions.

Limitation of liability

To the maximum extent permitted by law, Phixmo LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the platform.

Our total liability for any claim related to the service shall not exceed the amount you paid to Phixmo in the twelve months preceding the claim.

Termination

Either party may terminate this agreement at any time. You can cancel your account from the Settings page or by emailing us.

• Upon termination, your data will remain accessible for 30 days so you can export it.
• After the 30-day period, your data will be permanently deleted.
• We may terminate or suspend your account immediately if you violate these terms.
• Sections on limitation of liability, data ownership, and governing law survive termination.

Changes to these terms

We may update these terms from time to time. For material changes, we will notify you via email at least 30 days before the new terms take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

Governing law

These terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these terms or your use of the platform shall be resolved in the state or federal courts located in Wyoming.
